НотариусWhy you need a notary to buy property in Montenegro
In Montenegro every property sale must be certified by a notary (notar). Without notarial certification the contract has no legal force and cannot be registered in the cadastre. The notary checks the title documents, confirms there are no liens or encumbrances, verifies the identities of the parties and ensures the terms of the deal comply with Montenegrin law.
Notaries are distributed across municipalities (opština) — Podgorica, Budva, Bar, Kotor, Tivat, Herceg Novi and others. A notary operates throughout the country, but in practice it is more convenient to close the deal with a notary in the municipality where the property is located. The notary tariff is fixed by the state and calculated from the official Tarifni broj 1 schedule — it does not depend on which notary you choose, so the deciding factors are location and language.
